TAMPA, Fla. (970 WFLA) - Phil Campbell is no longer charged with DUI.
Pinellas-Pasco state attorney Bernie McCabe, who was appointed to investigate claims of misconduct, has concluded that the Tampa laywer was set up by rival lawyers during the high-profile and volatile defamation case between rival radio personalities Todd Schnitt and Bubba the Love Sponge.
Schnitt is a talk show host on NewsRadio 970 WFLA.
The report says someone with the Diaco law firm called a good friend, Tampa police Sgt. Ray Fernandez, that Campbell was at a local bar. Fernandez eventually arrested Campbell when Campbell moved a vehicle at the insistence of another Diaco paralegal, who encountered Campbell at that bar that evening.
Now the Tampa police department says it is cooperating with an FBI investigation into the case. Police Chief Jane Caster released this statement:
It is clear that Sgt. Ray Fernandez utilized bad judgement when he failed to remove himself from this investigation. He should have assigned it to an officer who did not have a personal connection to the tip. This would have avoided any potential appearance of impropriety.
The Tampa Police Department is working closely with the FBI on the offical investigation into this entire incident. When the investigation is complete, the department will then speak to the specifics of the case.
